Pro-XRP Advocate Forecasts Ripple-SEC Decision This Friday

The legal fight between Ripple and the US Securities and Exchange Commission (SEC) is continuous. The legal process ended 61 days ago with the final regular filings. Speculation in the community is currently high, with users like @CRYPTO_hitman speculating yesterday whether the decision will come as soon as this week, tagging famous pro-XRP lawyers in the community like Jeremy Hogan, Bill Morgan, John E. Deaton, James “MetaLawMan” Murphy, and Fred Rispoli.

Bill Morgan, another pro-XRP advocate, took part in the discussion and expanded it to include procedural aspects that would hinder the final decision on measures and sanctions.

Morgan commented, “Isn’t there a motion before Judge Netburn that needs to be decided before Judge Torres can decide on the sentence?” “Yes, that motion is still pending, but there is no procedural requirement that it be decided first,” Rispoli confirmed. Torres can inform Netburn that her decision negates the need for a decision on the expert/discovery issue while the two judges deliberate. “Thank you, Fred,” Morgan said in response to Rispoli’s clarification.

This legal discussion reported by Bitcoinist is in line with earlier predictions made by Rispoli. He proposed July 31 as a date for the decision, but he also mentioned that it could also come on July 13, which coincides with the anniversary of a crucial summary judgment from 2023. Judge Torres’ previous decision, which concluded that XRP is not a security, was a significant victory for Ripple in its legal battle with the SEC.

But as Morgan pointed out, there is still motion, which adds complexity to the procedures. In response to the SEC’s new expert documentation, including declarations and exhibits from freshly assigned expert witness Andrea Fox, Ripple filed a “motion to strike” on April 29th.

Judge Netburn’s decision regarding this motion could have important consequences. Judge Torres could proceed on this specific case with no additional rulings if Judge Netburn grants Ripple’s request. But as Rispoli expected, this should not hinder the final decision on the case’s remedies and sanctions. Therefore, a decision could be made this week.
